You are receiving this email because the Oregon Employment Department previously sent you an administrative determination that the Proof of Employment (POE) you submitted for your Pandemic Unemployment Assistance (PUA) claim did NOT meet requirements.

We will take one of the following steps regarding your PUA claim based on whether you provide additional information:

  • If your POE did not meet requirements and you have NOT submitted additional POE, we will send a new administrative determination with new hearing rights with specific, individualized reasons why your POE did not meet requirements.
  • If your POE did NOT meet requirements AND you have submitted additional POE, we will review the additional document(s) and do one of the following:
    1. Reverse or cancel the prior ineligibility administrative determination based on insufficient POE and reverse the resulting overpayment. That means you won’t have to pay us back.
    2. Issue a new administrative determination, with new appeal rights and an explanation about what rendered the submitted POE insufficient. That means you can appeal our decision.

If you received any PUA benefits after December 27, 2020, federal law requires that you must submit qualifying proof of employment.

You can still submit your POE document by September 4, 2021. If we receive a document from you by then, we will review your claim and may reconsider any prior decisions.

It is important to know that we generally will NOT review late POE documents after an Administrative Law Judge has heard your appeal AND has issued a decision based on the POE you submitted. We strongly encourage you to submit any new POE document before you file an appeal or have your hearing.

If you do NOT submit proof of employment by September 4, 2021, you will NOT be eligible for any weeks of PUA after December 26, 2020 AND you’ll owe an overpayment for the benefits you were paid after December 27, 2020. When there is an overpayment, that means you will have to pay back the benefits you received.

In general, if the first week you sought PUA benefits was in 2020, you must provide proof of employment from 2019. If the first week you sought PUA benefits was in 2021, you must provide proof of employment from 2020.

See which of these five situations apply to you:

  1. You worked for an EMPLOYER. , You must submit one (1) of the following documents:
  • Paycheck stubs with employer information
  • Earning and leave statements from your employer
  • W2s
  1. You were GOING TO START EMPLOYMENT. One (1) of the following documents are acceptable:
  • Employment offer letters (written from around the time of the job offer)
  • Signed statements verifying offer of employment that must include the name and contact information of the person making the statement. This statement may be notarized but that is NOT a requirement.
  1. You were SELF-EMPLOYED. One (1) of the following documents are acceptable:
  • State or federal identification numbers
  • Business registration or license filed prior to the first week you sought benefits
  • Tax returns with schedules included
  • Business receipts which may include bank statement or merchant processing statements
  • Signed and notarized affidavit from a person verifying your self-employment. A notarized affidavit means a notary public has witnessed the signing of the document.
  1. You were GOING TO START SELF-EMPLOYMENT prior to COVID-19. One (1) of the following documents are acceptable:
  • State or federal identification numbers
  • Business registration or license filed prior to the first week you sought benefits>
  • Business plans
  • Lease agreements
  1. You are showing YOUR ATTACHMENT TO ORGANIZATIONS such as the Peace Corps, AmeriCorps, or other educational or religious organizations. One (1) of the following documents are acceptable:
  • Documents provided by these organizations
  • Signed and notarized affidavit from someone verifying your attachment to the organization. A notarized affidavit means a notary public has witnessed the signing of a document.

The Employment Department provides free interpretation through our hotlines. We also provide the following language assistance options:

  1. Send your name, requested language, and phone number to OED_LanguageAccess@oregon.gov to receive a call back in your language.
  2. Call any WorkSource Center and request an interpreter in your language. Please call 211 for your local WorkSource Center number or visit http://www.worksourceoregon.org/Centers.html
  3. Call Worksystems at 1-503-606-6969 and request an interpreter in your language.
