Claims Against Your Landlord

If you want to take your landlord to Small Claims Court, here are some examples of demands you can make. You can use this information to write your demand letter

If your landlord doesn't follow the laws about entering your home with permission:

  • You can demand: One month’s rent.
  • Your legal reasons
    • You went into my home on (date) _____________. 
    • I know this because (reason) _____________.  
    • You must pay me one month’s rent, $________________, as required by law. 
  • Law violated: ORS 90.322(8).

 

If your landlord charges you a fee that is not listed in ORS 90.302(2), it is illegal. 

  • You can demand: Two times the fee charged or $300, whichever is more.
  • Your legal reasons: 
    • You charged me an illegal fee on (date) _________.  
    • The fee was for (reason) _________.   
    • You must pay me (two times fee amount or $300) $____________, as required by law.   
  • Law violated: ORS 90.322(8).

If your landlord doesn't follow the laws regarding getting your security deposit back:

  • You can demand: Two times the security deposit.
  • Your legal reasons: 
    • You did not pay me the security deposit (amount) __________________.  
    • Your deadline to pay was (date) ____________. You must pay me two times the amount of the deposit, $___________, as required by law. 
  • Law violated: ORS 90.300(16).
